Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Radius Delivery Shopify application, the radiusdelivery.app website and related support services (together, the “Service”). By installing, purchasing or using the Service, you agree to these Terms on behalf of the Shopify merchant or other business you represent.

1. Business use and authority

Radius Delivery is intended for Shopify merchants and other business users. You confirm that you have authority to accept these Terms for the business that owns or operates the connected Shopify store. If you do not agree to these Terms, do not install or use the Service.

2. What Radius Delivery provides

The Service helps merchants configure local delivery and pickup availability using Shopify Locations, delivery radii, custom delivery origins, polygon zones, Include Areas, Exclusion Zones, and address or place exceptions. Available features depend on the selected plan and on the capabilities made available by Shopify.

Radius Delivery provides configuration tools. It does not perform deliveries, act as a carrier, guarantee delivery times, or replace the merchant’s responsibility for pricing, fulfillment, customer service, taxes, consumer information, or compliance with laws applicable to the merchant’s business.

3. Shopify account and access

You need an eligible Shopify store and sufficient Shopify permissions to install and use the App. You are responsible for protecting your Shopify account and limiting staff access appropriately. You authorize Radius Delivery to access and process the Shopify information and permissions required to provide the features you choose.

The Service depends on Shopify APIs, Shopify Functions and other Shopify platform services. Changes, outages or restrictions affecting Shopify may temporarily limit the Service.

4. Plans, trials and billing

Plan names, current prices, billing intervals and any trial period are displayed on Shopify’s plan-selection and approval screens. Shopify handles subscription approval and adds applicable App charges to the merchant’s Shopify bill. Taxes may apply depending on the merchant’s billing location and Shopify’s billing rules.

You can change or manage your plan through the plan-management link inside Radius Delivery. To stop future billing, uninstall the App through Shopify Admin. A charge already generated for a current billing cycle may still appear on the Shopify invoice. Questions about a charge or refund request should be sent to hello@radiusdelivery.app. Refunds and billing adjustments are reviewed individually and, when approved, are processed through Shopify.

5. Merchant configuration and testing

You are responsible for reviewing every delivery origin, radius, polygon, inclusion, exclusion, address rule, pickup setting and checkout result before relying on it in a live store. Store locations must contain accurate and complete addresses. You should repeat testing after changing store locations, Markets, shipping settings, products, themes, checkout settings or other apps that affect fulfillment.

Maps, coordinates and geocoding results can contain errors or reflect incomplete source data. You must confirm that the saved coverage matches the area your business can actually serve.

6. Acceptable use

You must not misuse the Service, interfere with its security or operation, attempt unauthorized access, circumvent plan or usage limits, reverse engineer the Service except where applicable law expressly permits it, use it to violate another person’s rights, or use it for unlawful, deceptive or harmful activity.

7. Third-party services

The Service integrates with Shopify and may use hosting, database, mapping, geocoding, monitoring, email and other infrastructure providers. Third-party services are governed by their own terms and may change or become unavailable. We are not responsible for a third-party service outside our reasonable control, but we will use reasonable efforts to maintain compatible Service operation.

8. Privacy

Our processing of information is described in the Radius Delivery Privacy Policy. Merchants remain responsible for their own privacy notices and for instructions or choices they make when configuring delivery and pickup options for their customers.

9. Intellectual property

Radius Delivery, its design, software, branding, documentation and original content are owned by Multikapitał Sp. z o.o. or its licensors and are protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable and revocable right to use the Service for your Shopify business while your installation and applicable subscription remain active.

You retain ownership of configuration and business information you provide. You grant us the limited rights necessary to host, process and transmit that information solely to provide, secure and support the Service.

10. Availability, maintenance and changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, correct defects, change technical dependencies, or modify features when reasonably required for security, compliance, platform compatibility or product development. We will avoid materially reducing paid functionality without reasonable notice where practicable.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary or consequential loss, or for loss of profit, revenue, goodwill or data, arising from the Service. Our aggregate liability arising from the Service will not exceed the fees paid for Radius Delivery by the affected merchant during the 12 months before the event giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, liability for death or personal injury caused by negligence, or any liability that applicable law does not permit us to limit.

13. Suspension and termination

We may suspend or restrict access where reasonably necessary to address security risks, unlawful use, material breach of these Terms, non-payment reflected by Shopify, or threats to the Service or other users. Where practical, we will provide notice and an opportunity to correct the issue.

You may stop using the Service at any time by uninstalling the App. Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limits and governing law, remain effective.

14. Changes to these Terms

We may update these Terms when the Service, law or Shopify platform requirements change. The current version will be published at radiusdelivery.app/terms/ with its latest update date. Material changes will apply prospectively, subject to any notice required by applicable law.

15. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Courts having jurisdiction in Toruń, Poland will have exclusive jurisdiction, except where mandatory law requires another forum or grants rights that cannot be waived.
